Terms of Service

1. Acceptance of terms

By creating an account or using Brick Scanner ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Matthijs de Wit, a sole trader registered in the Netherlands.

2. The Service

Brick Scanner is a Progressive Web App that uses AI to identify LEGO bricks from photos and manage your LEGO inventory. The Service is provided on a scan-credit basis. Credits are consumed when a scan is successfully processed.

3. Accounts

• You must be at least 16 years old to create an account.
• You are responsible for keeping your account credentials secure.
• You may not share your account or transfer credits to another account.
• We may suspend or terminate accounts that violate these terms or abuse the Service.

4. Scan credits and payments

• Free plan users receive a limited number of scans per month at no charge. Paid credits are available as one-time purchase bundles.
• All payments are processed by Stripe. Prices are in euros and include applicable VAT.
• Scan credits are non-refundable once consumed. Unused credits from one-time purchases do not expire.
• Monthly free credits reset on the first day of each calendar month and do not carry over.

5. Right of withdrawal (herroepingsrecht)

Under EU Directive 2011/83/EU, consumers normally have a 14-day right of withdrawal for online purchases. However, pursuant to Article 16(m), this right does not apply to digital content that is delivered immediately upon purchase when the consumer has given prior explicit consent and acknowledged that the right of withdrawal is thereby lost.

• Before purchasing scan credits (bundles or subscriptions), you are asked to explicitly acknowledge that the credits will be available immediately and that you waive your 14-day right of withdrawal.
• This consent is recorded with a timestamp and a reference to your purchase.
• Once credits are delivered to your account, they are non-refundable.
• If you have not consumed any credits, you may contact us to request a goodwill refund at our discretion.

6. Acceptable use

You may not:

• Upload content that is illegal, harmful, or infringes third-party rights.
• Attempt to reverse-engineer or scrape the Service.
• Use automated tools to perform scans in bulk beyond normal personal use.
• Resell or sublicense access to the Service.
• Use the Service for commercial inventory management on behalf of third parties without a commercial plan.

7. AI accuracy disclaimer

Brick Scanner uses AI to identify LEGO parts. AI identification is not perfect. The Service aims for high accuracy but does not guarantee that every part, colour, or count is correct. You are responsible for verifying your inventory before making purchase, sale, or build decisions based on it.

8. Intellectual property

LEGO® is a trademark of the LEGO Group. Brick Scanner is an independent tool and is not affiliated with, endorsed by, or sponsored by the LEGO Group. All content you upload remains your property. You grant us a limited licence to process and store it solely to provide the Service.

9. Limitation of liability

To the maximum extent permitted by Dutch law, Brick Scanner is provided "as is" without warranty of any kind. We are not liable for loss of data, indirect damages, or loss of profits arising from use of the Service. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Termination

You may delete your account at any time from the settings page. Upon deletion, your personal data and scan images are removed within 30 days. Payment records are retained as required by law.

11. Changes to these terms

We may update these terms. When we do, we will notify you by email and update the "Last updated" date above. Continued use of the Service after the effective date constitutes acceptance.

12. Governing law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in Amsterdam, the Netherlands.
